Judge Weighs Urgent Order to Extend SNAP Benefits Amid Shutdown
URGENT UPDATE: A federal judge in Boston is actively considering whether to mandate the Trump administration to continue Supplemental Nutrition Assistance Program (SNAP) benefits during the ongoing government shutdown. This decision could affect approximately 42 million low-income Americans relying on these vital food benefits.
During a preliminary hearing on October 5, 2023, District Court Judge Indira Talwani expressed skepticism about the federal government’s claims that the current situation does not constitute an emergency. “You are not going to make everyone drop dead because it’s a political game someplace,” she asserted, responding to a lawyer from the U.S. Department of Agriculture (USDA), which administers the program.
The judge’s remarks came after New York Attorney General Letitia James and 24 other Democratic-led states demanded that federal officials tap into an emergency fund to keep SNAP benefits flowing. Judge Talwani highlighted that Congress had allocated money for such emergencies, questioning the administration’s stance on the matter.
“It’s hard for me to understand that this is not an emergency, when there is no money and a lot of people are needing their SNAP benefits,” Talwani noted. Her comments underscore the urgency of the situation, as the USDA is set to freeze SNAP payments within days due to funding lapses.
The SNAP program, which costs approximately $8 billion per month, serves about 1 in 8 Americans, forming a crucial part of the nation’s social safety net. In New York alone, nearly 3 million people depend on SNAP benefits, with 2 million residing in New York City’s five boroughs. These benefits are loaded onto recipients’ debit cards each month, enabling them to purchase essential groceries.
The USDA had previously indicated that it could utilize the contingency fund for SNAP benefits, as it has done during past shutdowns. However, a government lawyer cautioned that providing partial payments would necessitate extensive recalculations and system changes across states, potentially prolonging the process for beneficiaries.
Judge Talwani emphasized the necessity of finding a fair solution, stating, “If you don’t have money, you tighten your belt.” Her decision is expected soon, which could significantly impact millions of Americans dependent on this essential program.
