Trump Prosecutor Faces Fatal Threat Amid Major Legal Blunders
URGENT UPDATE: Major fallout unfolds for President Donald Trump’s appointed prosecutor, Lindsey Halligan, as new legal blunders threaten the case against former FBI Director James Comey. Legal expert David French warns that these errors could lead to the indictment being dismissed.
In a scathing analysis published by The New York Times on October 19, 2023, French highlighted a critical oversight in the grand jury process. Halligan reportedly failed to allow the grand jury to properly review the second indictment against Comey, a mistake that could have “fatal” implications for the prosecution.
French, a former litigator and vocal critic of Trump, stated, “I never witnessed the level of legal incompetence that we are witnessing from the Trump administration.” The situation has escalated following a magistrate judge’s findings that Halligan mishandled attorney-client communications involving Comey and his former lawyer, Daniel Richman, a law professor at Columbia Law School.
The judge raised serious concerns regarding Halligan’s adherence to legal protocols, pointing out potential violations of the Fourth Amendment during the execution of a search related to Richman. Furthermore, grand jurors reportedly challenged Halligan’s presentation of evidence, leading to a “fundamental and highly prejudicial misstatement of the law” regarding Comey’s Fifth Amendment rights.
This unfolding drama adds to the confusion surrounding the grand jury’s review of the second indictment, which the judge described as placing the court in “uncharted legal territory.” French noted, “If this procedure did not take place, then the indictment returned in open court was not the same charging document presented to and deliberated upon by the grand jury.”
As of now, the magistrate judge has not taken steps to dismiss the case, but French suggests that Halligan’s procedural missteps are only part of her mounting challenges. “We do not yet know if Halligan’s procedural irregularities will be fatal to the case,” he wrote, emphasizing the severity of the situation.
If Halligan’s level of malpractice were mirrored in other legal professions, French argues, it would likely result in instant dismissal from her role. The stakes are high as this case continues to evolve, potentially reshaping the legal landscape for Trump and his associates.
