Oklahoma’s New Open Container Law for Medical Marijuana Takes Effect

UPDATE: A new law in Oklahoma has just taken effect, mandating that drivers must keep all medical marijuana products sealed and out of reach while in their vehicles. Failure to comply could lead to open container charges, significantly impacting how medical marijuana users transport their products.

Under this legislation, authored by Senator Darrell Weaver (R-Moore), unsealed marijuana products are strictly prohibited from being transported in the front seat. Additionally, passengers are not allowed to consume any marijuana products while the vehicle is in motion. This urgent update aims to enhance road safety and reduce impaired driving incidents.

According to Aaron Brilbeck from the Oklahoma County Sheriff’s Office, many drivers mistakenly believe that presenting their medical marijuana card provides an exemption from traffic laws. “They hand us their driver’s license and their medical marijuana card, like it’s some kind of get out of jail free card,” Brilbeck stated. He emphasized that this new law sends a clear message: “You can’t have anybody smoking in your vehicle.”

Senator Weaver reinforced this perspective, stating, “What this is about is just being reasonable, and we don’t want impaired drivers on the road.” He urged drivers to ensure that any medical marijuana products are kept in the back seat or trunk of their vehicles, away from the driver’s reach.

Brilbeck further advised, “The package that you purchased it in is the package that it needs to remain, and that package needs to be sealed.” This crucial reminder highlights the responsibility of medical marijuana users to adhere to the new regulations.

In addition to potential fines for violations, an extra $250 trauma care fee will be imposed, contributing to the Oklahoma Trauma Care Assistance Revolving Fund. This fee adds another layer of financial responsibility for those who fail to comply with the law.
