San Diego Files Lawsuit Against Federal Government Over Border Fence

The city of San Diego has initiated a lawsuit against the federal government, claiming that the construction of a razor wire fence near the U.S.-Mexico border infringes on city property and has caused environmental damage. The lawsuit was filed on January 2, 2026, in federal court in San Diego, alleging that the razor wire fencing erected by U.S. Marines in the Marron Valley has negatively impacted protected plant and wildlife habitats.

According to the complaint, city officials first identified the presence of federal personnel in the area in December 2025. The lawsuit specifically names the U.S. Department of Homeland Security and the U.S. Department of Defense as defendants, asserting that their actions constitute unauthorized trespassing on city land. The construction of the fence has prevented city officials from accessing the property to conduct assessments and manage the land effectively.

The lawsuit highlights that the ongoing construction efforts have resulted in property damage and adverse environmental impacts. In response to these developments, city officials are seeking an injunction that would order the federal government to cease all construction and trespassing activities in the area.

Heather Ferbert, the City Attorney for San Diego, emphasized the city’s commitment to protecting its resources and habitats. “The city of San Diego will not allow federal agencies to disregard the law and damage city property,” Ferbert stated. She added that the city is taking decisive action to uphold environmental commitments and ensure community rights are respected.

In response to the lawsuit, a spokesperson for the Department of Homeland Security stated that under the previous administration, significant measures were taken to enhance border security. The spokesperson expressed confidence in the department’s approach, stating, “DHS will continue to use every tool in its toolbox to defend the American people from dangerous foreign criminals—and we look forward to challenging this lawsuit.”

The conflict surrounding the razor wire fence highlights ongoing tensions between local governments and federal authorities over border security measures. As legal proceedings unfold, the city of San Diego remains firm in its stance against unauthorized federal actions that it believes threaten both local property and the environment.
