Supreme Court Vacates Federal Judgments Over Jurisdiction Defects
The U.S. Supreme Court has unanimously ruled that federal judgments are invalid if jurisdictional defects remain unresolved. This decision, stemming from the case of Hain Celestial Group, Inc. v. Palmquist, clarifies the boundaries of federal diversity jurisdiction and emphasizes the need for careful consideration in removal strategies.
In this case, the Palmquists, residents of Texas, filed a lawsuit against Hain Celestial Group, Inc. and Whole Foods Market, Inc. in a Texas state court. Hain, an out-of-state company, sought to move the case to federal court by arguing that Whole Foods, a Texas-based entity, had been improperly joined. The federal district court agreed, dismissing Whole Foods and allowing the case to proceed. However, the Fifth Circuit later reversed this decision, reinstating Whole Foods and determining that the federal court lacked jurisdiction.
On February 24, 2026, the Supreme Court ruled that the erroneous dismissal of Whole Foods did not cure the jurisdictional defect. Justice Sonia Sotomayor, writing for the Court, stated that “federal courts are courts of limited jurisdiction.” The Court emphasized that if an appellate court finds a lack of jurisdiction, it must vacate any judgments on the merits. This ruling reinforces the principle that a district court cannot establish jurisdiction through its own erroneous decisions.
Implications for Corporate Litigants
The implications of the Supreme Court’s ruling are significant for companies involved in litigation. Those relying on the improper-joinder doctrine face increased risks. Should an appellate court decide that a nondiverse defendant was correctly joined, any judgment obtained will be vacated, regardless of the extent of litigation that has taken place.
Justice Sotomayor noted that the case of Caterpillar Inc. v. Lewis provided an exception to this rule, where a jurisdictional defect was cured before trial. However, in the Hain Celestial case, the defect remained unresolved, leading to the requirement for vacatur.
Justice Clarence Thomas also raised concerns regarding the improper-joinder doctrine, suggesting it may allow federal courts to extend their jurisdiction by evaluating the merits of state-law claims. He indicated a willingness to revisit this doctrine in future cases.
Corporate litigants must assess their removal strategies with greater caution. The Court’s ruling stresses the importance of resolving improper-joinder disputes before trial, potentially through Rule 54(b) partial final judgments or interlocutory certifications.
Strategic Considerations Going Forward
Litigants should consider early appellate review of joinder decisions. Additionally, defendants may opt to dismiss nondiverse parties in state court before seeking removal to federal court. This approach ensures that the removal is based on solid grounds, provided the dismissal is granted by the state court.
Another potential strategy involves moving to dismiss weak claims against nondiverse co-defendants in state court. Under 28 U.S.C. § 1446(b)(3), defendants have 30 days to remove the case after becoming aware that it is removable. However, parties must remain cognizant of the one-year limitation on diversity removal and the possibility of challenges to dismissals in state appellate courts.
The Hain Celestial decision has broader implications, particularly for product liability and mass tort cases where multiple defendants are involved. Plaintiffs can strategically include in-state retailers to defeat removal, as this ruling confirms that an erroneous dismissal at the trial level does not protect the judgment from being vacated on appeal.
As the legal landscape evolves, litigants must stay alert for further developments regarding the improper-joinder doctrine. Justice Thomas’s comments suggest that significant changes may be on the horizon, prompting a closer examination of how federal courts handle jurisdictional issues related to diverse parties.
